The Hispanic National Bar Association and the HNBA Vision in Action Fund (collectively “HNBA”) prepared this online Privacy Notice (“Privacy Notice”) to explain how we process and safeguard Personal Information (defined below) in different contexts using ethical and responsible practices that respect your privacy, as required by law.

This Privacy Notice applies to Personal Information collected on our online platforms with a link to this Privacy Notice (collectively, the “Site”).  It covers how we collect, use, share, and otherwise process Personal Information as of the date that this Privacy Notice is posted.  It does not apply to any other information collected by us through any other means, including separate business or marketing activities.  “Personal Information” refers to information that identifies or can identify you personally, including any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or its equivalent.

Information We Collect 

For public areas of our Site, we generally collect and process only Personal Information you voluntarily provide to us.  To use certain portions of our Site, however, we may require you to provide Personal Information to authenticate you, including your name, date of birth, or other information.  We may also collect your Personal Information to perform services on our Site, enhance the services offered to you, maintain and improve the Site, secure our Site, comply with legal obligations, and inform you about other services and products that may be available through HNBA, our affiliated companies, and our marketing partners.  If you choose not to provide us with the Personal Information that is legitimately required, we may be unable to provide you with the information or services you have requested.  Public areas of our Sites ask for Personal Information from you when you engage in the following activities:

Personal Information may include any or all of the following:

   2. Postal or billing address
   3. E-mail address
   4. Telephone or mobile number
   5. Payment card information
   6. Location via IP address
   7. Device being used
   8. Previous history with our Site
   9. Other relevant data, including any information you provide when contacting us

Even if you do not send us any Personal Information, we may collect certain non-personal information about how you use our Site. This non-personal information cannot reasonably be used to identify you and is used for statistical purposes.

Information We Collect Through Technologies

We may also obtain information in other ways through technology. Some of this information may be linked to you personally.  HNBA processes this information to help our Sites function correctly and better understand the needs of our visitors.

Device Information. Depending on the permissions you have granted and other factors, HNBA may receive information about your approximate geographic location and your mobile device, including a unique identifier for your device, based on your IP address.

Most mobile devices allow you to turn off location services, and we encourage you to contact your device manufacturer for detailed instructions on how to do that.

Cookies and Other Tracking Technologies

The technologies we use for automatic data collection may include Google Analytics or third-party advertisers. “Cookies” (or browser cookies) are small files placed on the hard drive of your computer. Cookies are used to compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Site. Unless you have adjusted your browser settings so that it will refuse cookies, our system will issue cookies when you direct your browser to our Site.

Cookies on our Site generally fall into the following categories:

Controlling Our Tracking Tools. Your browser may give you the ability to control cookies. How you do so, however, depends on your browser and the type of cookie. Certain browsers or browser plugins can be set to reject all browser cookies. If you configure your computer to block all cookies, you may disrupt certain web page features and limit the functionality we can provide when you visit or use our Site (e.g., we will not be able to provide you with searches that you have asked us to save). Third Party Cookies.  We may include a link to or offer third-party products or services on the Site.  These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you.  We do not control these third parties’ tracking technologies or how they may be used.  Third-party sites have separate and independent privacy notices.  Nonetheless, we encourage you to review those separate privacy notices before sharing information about you.

Global Privacy Control.  Additionally, we process opt-out preference signals from Global Privacy Control (“GPC”). GPC is a browser-level technical specification that you can use to inform websites that you opt-out of sales or sharing of data for cross-context behavioral advertising or targeted advertising.  If you use GPC, our website will treat the browser and device you use to access our website as opted-out from sales or sharing to the extent we engage in such processing. How We Use and Share the Information We Collect

Whatever the purpose may be – whether we share with service providers, consultants, government authorities, or other external entities – we only process and share your Personal Information to the extent reasonably necessary to fulfill your requests and meet our legitimate business and legal objectives.  We do not share your Personal Information with unaffiliated third parties solely for their own direct marketing purposes. We do not sell your Personal Information.  When we disclose Personal Information to external entities to perform support services for us, we establish by contract that they may access your Personal Information only for the purposes of performing those support services.  We may also use what we know about you to potentially offer you other products and services in the future.  We may combine your online information with information collected from offline or online sources, or information we already have.  We may also use and disclose certain Personal Information to our affiliated companies and others for any purpose allowed by law.

Business Activities. We generally process and may disclose your Personal Information to others to:

  • Verify your identity or other fraud prevention measures and reporting obligations
  • Send you communications about a program or service, ads and promotions, electronic newsletters, or other marketing activities
  • Participate in surveys, contests, or promotions
  • Comply with applicable law, obey judicial orders, cooperate with law enforcement authorities, or prevent any suspected illegal activities
  • Perform Site analytics
  • Help us run our business
  • For any other everyday business purposes, such as product development and Site administration

Location Data.  The third-party mobile application may access your device’s GPS or other location services to show nearby locations, directions, or other information.  You can disable location sharing in your device settings, but some app features may be limited.  We use this info to provide relevant services based on your location.

Sale of the Business. If we sell all or part of our business, Personal Information may be transferred to the purchaser in connection with that transaction. We will use reasonable efforts to include contractual provisions that require the purchaser to treat your Personal Information consistently with the terms of this Privacy Notice.

Other Disclosures. We may disclose Personal Information as permitted or required by law, when we believe in good faith it is necessary for safety purposes, required for legal reporting, to protect our legal rights or enforce our Site’s terms and conditions or any applicable rules, or to protect the rights of others.  We may also disclose Personal Information to our auditors, legal advisors, or to respond to a subpoena.  Any access to your Personal Information is restricted to those individuals who have a need to receive or access this data in order to fulfill their job responsibilities.  We may also aggregate information that we gather about you (e.g., traffic patterns) and provide these statistics to others in aggregate form.

Minors

This Site is intended for use by adults.  This Site is not intended or directed at individuals under the age of 18, and we do not knowingly collect any Personal Information from minors or knowingly track the use of our Site by children. If you believe we have impermissibly collected Personal Information from someone under the age of 18, please contact us directly.

Your Privacy Rights

Certain jurisdictions confer specific privacy rights on individuals.  We will address those rights as required by applicable laws. If you wish to exercise any of these rights, please contact us as specified in the Contact Information section below.

1. 1. Right of Access: You have the right to confirm if Personal Information concerning you is processed, and gain access to that information.
   2. Opt-out right.  You may opt out of targeted advertising or profiling of your Personal Information.
   3. Right to rectification.  You may ask us to correct inaccurate Personal Information that we have about you.
   4. Right of erasure.  You may ask us to delete certain Personal Information we have collected from you, as long as it is not aggregated or de-identified, or required for legal or regulatory purposes.

You also have the right to know: (1) what categories of Personal Information concerning you are being processed, (2) the purpose for processing the Personal Information, (3) how you can exercise your rights, including how to appeal a decision regarding a request, (4) the categories of Personal Information concerning you that are shared with third parties, if any, and (5) the categories of third parties, if any, the controller shares their Personal Information with.

Security

We have implemented reasonable and appropriate measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. And while we strive to protect your Personal Information, we cannot guarantee or warrant the security of any information you transmit to us, or to or from our services.

Data Retention

We retain your Personal Information for as long as necessary to fulfill the purposes outlined in this Privacy Notice, unless a longer retention period is required or permitted by a law that applies to us.

Changes to Our Privacy Notice

We may amend this Privacy Notice from time to time. If we make any material change in how we collect, use, disclose, or otherwise process Personal Information, we will prominently post an updated Privacy Notice on our Site. Any changes to this Privacy Notice will be effective immediately upon posting of the updated Privacy Notice or as otherwise required by applicable law.
